"Subaru" includes predecessors, successors, assigns, parents, subsidiaries, affiliates, service providers, contractors, and their officers, directors, employees, and agents.
All disputes shall be resolved individually in binding arbitration or small claims court (if applicable). Arbitration uses a neutral arbitrator instead of a judge, with no jury, less discovery, and fewer appeals.
This provision is governed by the Federal Arbitration Act. The American Arbitration Association administers arbitrations under Consumer Arbitration Rules, obtainable at www.adr.org or 1-800-778-7879.
To commence arbitration, follow AAA website instructions, send a Demand for Arbitration, pay filing fees, and mail a copy to: Subaru of America, Inc., One Subaru Drive, Camden, NJ 08103, ATTN: LEGAL - ARBITRATION OF DISPUTE.
If multiple similar claims are pending, parties shall jointly petition the AAA to coordinate matters for efficiency. This does not authorize class or collective actions.
Unless agreed otherwise, a single arbitrator will conduct the arbitration in the county where you reside. The arbitrator will issue a written decision explaining findings and conclusions.
If Subaru commences arbitration, Subaru pays all AAA fees and costs.
If you commence and cannot afford the filing fee, Subaru will pay it (unless AAA waives it). Subaru may recover fees if your representation about inability to pay is false.
If you commence and claim value is less than $10,000, you pay only the lesser of AAA filing fee or local small claims court filing fee, with Subaru paying remaining costs (unless Subaru has received 25+ similar notices).
If either party's claim is frivolous, that party reimburses the other's fees and costs.
You may pay up to half of AAA's fees if you wish.
You may hire attorneys to represent you. You pay their fees, which may be recoverable from Subaru as in court. If the arbitrator finds a claim frivolous, the other party may recover its attorney fees and costs.
If a legal action outcome is less favorable than a rejected settlement offer, the seeking party must pay all fees and costs, including reasonable attorney fees, incurred after the offer.
WHETHER IN ARBITRATION OR COURT, YOU AND SUBARU WAIVE THE RIGHT TO PROSECUTE OR PARTICIPATE IN CLASS ACTIONS, COLLECTIVE ACTIONS, OR OTHER REPRESENTATIVE ACTIONS, OR SEEK REDRESS FOR ALLEGED INJURIES TO THIRD PARTIES.
WHETHER IN ARBITRATION OR COURT, YOU AND SUBARU WAIVE THE RIGHT TO SEEK PUBLIC INJUNCTIVE RELIEF (this waiver can be severed if unenforceable).
You may opt out by sending certified mail notice postmarked within 30 days of the effective date to: Subaru of America, Inc., One Subaru Drive, Camden, NJ 08103, Attention: Legal Department. Your decision will not affect your relationship with Subaru.
You may reject changes by sending certified mail notice postmarked within 30 days of first receiving notice of changes to: Subaru of America, Inc., One Subaru Drive, Camden, NJ 08103, Attention: Legal Department. Your decision will not affect your relationship with Subaru.
This arbitration provision survives agreement cancellation or expiration.
